Terms of Service

By creating an account, accessing the Platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules we may publish.

Acceptance Methods: You accept these Terms by: (1) clicking "I Accept" or similar buttons during account creation, (2) accessing or using the Platform, (3) participating in our community features, or (4) making a payment for any of our services.

Modifications: We reserve the right to modify these Terms at any time. We will notify you of material changes through email, in-app notifications, or by posting a notice on our Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

Important Note: If you do not agree to these Terms or any future modifications, you must immediately cease using our Platform and contact us to terminate your account. Continued use indicates full acceptance of all terms and conditions.

Account Creation: To use DevMates, you must create an account by providing accurate, current, and complete information including your name, email address, and professional details. You agree to promptly update your account information if any changes occur. Providing false or misleading information may result in account suspension or termination.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials (username and password). You must use a strong, unique password and enable two-factor authentication when available. You agree to immediately notify us at security@devmatesapp.com of any unauthorized access or security breach.

Account Responsibilities: You are fully responsible for all activities that occur under your account, whether or not authorized by you. You may not: (1) share your account with others, (2) use another user's account without permission, (3) create multiple accounts for fraudulent purposes, or (4) transfer your account to another person without our written consent.

Age Requirements: You must be at least 13 years old to use DevMates. Users between 13 and 18 years old must have explicit parental or legal guardian consent. By using our Platform, you represent and warrant that you meet these age requirements and have obtained necessary parental consent if applicable.

Professional Verification: DevMates may verify your professional credentials, work history, or skills through third-party services or direct verification. You authorize us to conduct such verification and agree to provide additional documentation if requested.

As a member of the DevMates community, you are expected to maintain professional conduct and respect for all users. You agree to use the Platform responsibly and in compliance with all applicable laws and regulations.

Prohibited Activities: You explicitly agree not to:

• Violate any local, state, national, or international laws or regulations
• Infringe upon intellectual property rights, including copyrights, trademarks, patents, or trade secrets
• Upload, transmit, or distribute malicious code, viruses, worms, trojans, or any harmful software
• Harass, bully, intimidate, threaten, abuse, or harm other users physically or psychologically
• Impersonate any person or entity, or falsely represent your affiliation with any organization
• Collect, harvest, or scrape user data without explicit written consent from DevMates
• Send spam, unsolicited advertising, promotional materials, or engage in unauthorized marketing
• Attempt to gain unauthorized access to our systems, servers, networks, or other users' accounts
• Interfere with or disrupt the Platform's operation, servers, or networks
• Use automated tools, bots, or scripts to access or interact with the Platform without permission
• Post or share content that is illegal, obscene, defamatory, fraudulent, or violates third-party rights
• Engage in discriminatory behavior based on race, ethnicity, gender, religion, disability, or sexual orientation

Professional Standards: All interactions on DevMates should be professional, constructive, and respectful. We encourage collaboration and expect users to maintain integrity in all communications and transactions.

Reporting Violations: If you encounter any user violating these conduct rules, please report them immediately through our reporting system or by contacting abuse@devmatesapp.com.

Your Content Ownership: You retain full ownership and all intellectual property rights to any content you create, upload, post, or share on DevMates ("User Content"). This includes but is not limited to profile information, project descriptions, portfolio items, messages, comments, code samples, designs, and any other materials you contribute.

License Grant to DevMates: By posting User Content on the Platform, you grant DevMates a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the Platform. This license allows us to:

• Display your profile and content to other users for networking and collaboration purposes
• Create thumbnails, previews, and modified versions for display optimization
• Use your content in marketing materials with your explicit permission
• Enable content sharing features like embedding and social media integration
• Perform analytics and improve our services based on user-generated content

Content Representations: You represent and warrant that: (1) you own or have necessary rights to all User Content you post, (2) your User Content does not violate any third-party rights, and (3) you have obtained all necessary permissions, releases, and licenses for any content featuring third parties.

Platform Content: All DevMates branding, logos, designs, text, graphics, interfaces, code, software, and functionality are owned by DevMates and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or exploit any Platform content without our express written permission.

DMCA Compliance: We respect intellectual property rights. If you believe your copyright has been infringed, please contact our DMCA agent at dmca@devmatesapp.com with detailed information about the alleged infringement.

Your privacy and data security are of paramount importance to DevMates. We are committed to protecting your personal information and being transparent about our data practices. Please review our comprehensive Privacy Policy to understand how we collect, use, store, and protect your personal information.

Data Collection: We collect information you provide directly (account details, profile information, communications), information generated through your use of the Platform (activity logs, interactions, preferences), and information from third-party sources (social media profiles, professional networks) when you authorize such connections.

Data Usage: We use your information to: (1) provide, maintain, and improve our services, (2) facilitate connections between users, (3) personalize your experience and recommendations, (4) communicate with you about updates and opportunities, (5) ensure Platform security and prevent fraud, and (6) comply with legal obligations.

Data Sharing: We do not sell your personal information. We may share your data with: service providers who assist in Platform operations, other users as part of normal Platform functionality, business partners with your consent, and legal authorities when required by law.

Your Rights: You have the right to access, correct, delete, or export your personal data. You can control your privacy settings, manage communication preferences, and request data deletion at any time through your account settings or by contacting privacy@devmatesapp.com.

Consent: By using DevMates, you explicitly consent to the collection, use, and sharing of your information as described in our Privacy Policy and these Terms. You may withdraw consent at any time, though this may limit your ability to use certain Platform features.

Termination by DevMates: We reserve the right to suspend, disable, or terminate your account and access to the Platform at any time, with or without prior notice, for any reason including but not limited to: violations of these Terms, fraudulent activity, abusive behavior, prolonged inactivity, legal requirements, or our determination that your continued access could harm DevMates or other users.

Termination by You: You may terminate your account at any time by accessing your account settings and selecting the account deletion option, or by contacting our support team at support@devmatesapp.com. Upon deletion, your profile and associated data will be removed from public view within 30 days.

Effects of Termination: Upon termination: (1) your right to access and use the Platform immediately ceases, (2) your public profile and content may be removed, (3) active subscriptions and services will be discontinued, and (4) you will lose access to any data stored on the Platform. We may retain certain information as required by law or for legitimate business purposes.

Data Retention: After account termination, we may retain backup copies of your data for up to 90 days for recovery purposes and permanently retain anonymized data for analytics. You may request complete data deletion by submitting a formal request to our privacy team.

Survival: Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to: Content Ownership, Limitation of Liability, Indemnification, and Dispute Resolution provisions.

"AS IS" and "AS AVAILABLE" Basis: THE DEVMATES PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DEVMATES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

No Guarantees: We make no warranties or representations that: (1) the Platform will be uninterrupted, timely, secure, or error-free, (2) the results obtained from using the Platform will be accurate or reliable, (3) any errors or defects in the Platform will be corrected, (4) the Platform or servers are free of viruses or other harmful components, or (5) connections facilitated through the Platform will result in successful collaborations or partnerships.

Third-Party Content: DevMates does not control, endorse, or assume responsibility for any third-party content, user-generated content, external websites, or services accessed through the Platform. You acknowledge that DevMates has no obligation to screen, monitor, or verify any content posted by users.

User Interactions: DevMates is not responsible for the conduct, actions, or omissions of users. We do not guarantee the accuracy of user profiles, credentials, or representations made by users. You are solely responsible for evaluating and verifying the identity, qualifications, and suitability of other users before engaging in any collaboration, transaction, or relationship.

Service Availability: We do not warrant that the Platform will be available at all times or free from technical difficulties. We may experience downtime due to maintenance, upgrades, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature or the entire Platform at any time without liability.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVMATES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

Excluded Damages: This limitation includes but is not limited to damages for: (1) loss of profits, revenue, data, or business opportunities, (2) loss of goodwill or reputation, (3) service interruption or data corruption, (4) cost of substitute services, (5) unauthorized access to or alteration of your data, (6) statements or conduct of any third party on the Platform, or (7) any other matter relating to the Platform.

Maximum Liability Cap: In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, DevMates' total liability to you for all claims arising from or related to these Terms or your use of the Platform shall not exceed the greater of: (a) $100 USD, or (b) the amount you paid to DevMates in the 12 months preceding the claim.

Basis of the Bargain: You acknowledge and agree that these limitations of liability are fundamental elements of the agreement between you and DevMates. The Platform would not be provided to you without these limitations.

Indemnification: You agree to indemnify, defend, and hold harmless DevMates and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (1) your use of the Platform, (2) your violation of these Terms, (3) your violation of any rights of another party, or (4) your User Content.

Right to Modify: DevMates reserves the right to modify, update, or replace these Terms at any time at our sole discretion. We may make changes to reflect: changes in applicable laws or regulations, security enhancements, new features or services, user feedback, or evolving business practices.

Notification of Changes: We will notify you of material changes to these Terms through one or more of the following methods: (1) prominent notice on the Platform homepage, (2) email notification to your registered email address, (3) in-app notification or banner, or (4) notification through your account dashboard. Minor changes may be made without notice.

Effective Date: Changes to these Terms will become effective immediately upon posting to the Platform unless we specify a later effective date. The "Last Updated" date at the top of this page indicates when the Terms were last modified. We encourage you to review these Terms periodically.

Acceptance of Changes: Your continued access to or use of the Platform after the effective date of any changes constitutes your binding acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and may request account termination.

Version History: We maintain a version history of our Terms. You can request access to previous versions by contacting legal@devmatesapp.com. Major revisions will be archived and made available for your reference.
